Actress Lindsay Lohan is suing E*Trade for $100 million, claiming a "milkaholic" baby in a recent TV commercial from the online broker is based on her.

E*Trade first aired the latest in its notorious series of baby adverts during the Super Bowl last month and it has since appeared during other profile events such as the Winter Olympics.

It features a baby explaining to his girlfriend via a Web cam that he failed to call her the previous night because he was managing his portfolio on the firm's site.

"And that milkaholic Lindsey wasn't over?" the girlfriend quizzes, prompting another baby girl to jump into the frame on the boy's side asking "milk-a-what?"



In a suit filed on Monday in a Nassau County, New York state court, it is claimed the commercial "includes plaintiff's name, characterisation, and personality" without her consent or authorisation.

The actress is seeking $50 million in compensatory damages, $50 million in exemplary damages and demanding that the ad stops airing.
